1. Acceptance of Terms
In accessing and using the managetrainlearn Web Site, (the "Web Site"), you agree to accept and comply with the following terms and conditions of use, (the "Agreement"). Managetrainlearn.com is a service and trademark of KSA Training (the "Company"). Unless otherwise indicated, the Web Site and its contents are the property of the Company and are protected, without limitation, pursuant to English and foreign copyright and trademark laws. The Company may, at its sole discretion and at any time, amend the terms of this Agreement by updating this Legal Notice. It is your responsibility to check this page from time to time and ensure that you are aware of any such modifications.
2. Description of Service and Products
The Company currently provides access to website features (the “Service”) and a comprehensive range of learning software and associated features, (the "Products"). As part of the Company's aim to provide the best products to customers, the content, design and features of the Service and Products are continually reviewed, amended and updated in the light of new developments, information and thinking. Except where explicitly stated, any addition of features or content to the Service and Products shall be covered by this Agreement.
The Company makes no representations or warranties with respect to the Web Site or its contents which are provided "AS IS". The Company disclaims all warranties, express or implied, including without limitation, the implied warranties of title, non-infringement, merchantability, fitness for a particular purpose, with respect to the Web Site. No warranty or guarantee is made by the Company that any user of the Web Site, Service or Products will master any particular skill, attain any particular qualification, pass any particular examination or achieve any tangible result based upon the use of the Web Site. The Company also makes no representations or warranties that the information accessible via the Web Site is accurate, complete or current. Although every effort is made to ensure that the Service and Products are error-free and free of computer viruses or other harmful items, the Company makes no warranty to that effect and is not responsible for any material or financial loss incurred while using the Service or Products, however incurred.
4. Limitation of Liability
To the fullest extent permitted by applicable laws, the Company and its employees, agents, suppliers and contractors shall in no event be liable for any claims, charges, damages, liabilities, losses and expenses of whatever nature and howsoever arising, including, without limitation, any compensatory, incidental, direct, indirect, special, punitive, or consequential damages, loss of use, loss of data, loss caused by a computer or electronic virus, loss of income or profit, loss of or damage to property, claims of third parties, or other losses of any kind of character, even if the Company has been advised of the possibility of such damages or losses, arising out of, or in connection with, the use of the Web Site, Service or Products. You assume total responsibility for establishing such procedures for data back up and virus checking as you consider necessary.
5. Prices and Taxes
Payments for Products are made via our shopping cart system by credit card. Links to products are sent only after full payment has been made. We do not accept other forms of payment due to the extra administration this would involve.
Charges for Products shall be those ruling on the date of order. Prices are those shown and may be subject to change without notice and may include UK VAT if and where applicable.
For UK- and EU-based clients, companies and organizations who are not VAT-registered, if VAT is activated within our company, we must add the current VAT of 17.5% to any relevant prices listed on this Web site, when VAT becomes applicable.
For UK- and EU-based clients who are VAT-registered, our shopping cart system identifies the VAT content of your order so that you can claim the VAT value back through your own country's tax authorities, if applicable.
It is the responsibility of the customer to pay any local taxes or import duties that may apply.
6. Copyright and Intellectual Rights
All contents of the Web Site, Service and Products are the intellectual property of the Company, ALL RIGHTS RESERVED. Your registration to the Web Site, Service and Products entitles you to freely access and use some content. Your rights to access both free and paid-for content are strictly limited to the conditions of the licenses bought. Except as otherwise expressly permitted, you may not modify, publish, transmit, participate in the transfer or sale of, create derivative works or in any way exploit any of the content, whole or in part. In the event of permitted copying, re-distribution or publication of copyrighted material, no changes in or deletion of, author attribution, trademark legend, copyright or other proprietary notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyrighted material.
You hereby agree to indemnify and hold harmless the Company from and against any and all claims, charges, demands, damages, liabilities, losses, expenses and liabilities of whatever nature and howsoever arising, (including, but not limited to, any legal or other professional fees and the costs of defending or prosecuting any claim and any loss of profit, goodwill and any other direct or consequential loss) incurred or suffered by the Company directly or indirectly by reason of any act or omission which you commit in breach of these terms and conditions and the obligations and warranties contained in them.
8. Refund Policy
Any refunds are given at the sole discretion of the Company. This does not affect your statutory rights.
